I knew and trusted Alan and Heather for years before I suddenly found myself in a situation where I needed their expertise. I am also an attorney in San Francisco, but practice in a different area of the law. Knowing how honest, trustworthy and skilled both Alan and Heather are at employment law, I was confident that they would tell me whether or not I had a case. My former employer failed to pay me fully for the work I performed. The challenge for me was that we had a verbal contract regarding the terms of my wages. So, proving the terms of the contract was going to be very tough. Further, there was an issue about whether or not I was considered an "employee" or an "independent contractor." By claiming that I was an independent contractor instead of an employee, my employer was attempting to pay me much less than what I was actually owed.

I suspect that representing another attorney adds to the pressure of litigation. Talk about the potential for back seat driving! It didn't seem to bother them. Alan and Heather's overall approach to my case and the sheer tenacity they brought to the table really impressed me. They act as a very fluid team, and balance each other's talents well. Leveraging those talents, Alan and Heather devised a very solid strategy for reaching a mediated settlement that I was very happy with.

I'm a pretty verbal person, and as an attorney, I can tend to spout-off. Alan and Heather were great about keeping me in-check throughout the case to ensure I never stepped on their toes or bumped our strategy off-course. We went into mediation with a clear plan. Following Alan and Heather's direction, the mediation process went exactly the way they told me it would – only faster. Bayer & Borlase executed their plan to perfection. And knowing them the way I do, I was not surprised in the least.
